Food Business Requirements & Registration

Devonport City Council is committed to ensuring that businesses that prepare and have foods for public sale and consumption meet the requirements of the Food Act 2003 and all appropriate State and National standards and legislation.

Step 1

Do you need to Register or Notify?

The type of food you handle and where it will be sold determines what you must do under the Food Act 2003. Every food business must do one of the following.

Higher risk activities

Register

Required for businesses that handle or sell food to the public. This includes:

  • Restaurants
  • Cafes
  • Coffee vans
  • B and B accommodation
  • Home baking business (cakes, slices, etc.)
  • Charitable organisations who sell food, even for fundraising
Valid for up to 12 months. Fee depends on risk level.
Very low risk activities

Notify

For very low risk food handling activities only. This includes:

  • Bottle shops
  • Petrol stations selling soft drinks
  • Chemists and newsagents selling lollies
  • Green grocers selling uncut fruits and vegetables
  • Baking bread
Free, one-off notification. No renewal needed.

Registration

Food Business Registration (and subsequent renewal) is valid for a maximum of 12 months. The fee required for registration varies depending on the level of risk of the food handling activities. Click here to view Council's current fee structure.

Mobile food businesses Tents, stalls or mobile food vans may apply for a Statewide Registration and must comply with the Guidelines for Mobile Food Businesses.
First time registering An Environmental Health Officer will inspect the premises before issuing a Certificate of Registration.

Temporary Food Stall Application

If you wish to operate a once off Temporary Food Stall (such as a fundraising sausage sizzle or farmers market stall), you have two registration options:

One day eventA single day stall or fundraiser
Two to four day eventA stall running across multiple consecutive days

Notification

Food Business Notification is only for very low risk activities, such as bottle shops, petrol stations selling soft drinks, chemists and newsagents selling lollies, green grocers selling uncut fruits and vegetables, and baking bread.

Notification only needs to be done once, unless you alter the types of food handled or change address. There is no charge for Notification.

A Food Business Notification generally covers the registered premises only, however businesses operating from a mobile structure (such as a stall or mobile food van) may apply for a Statewide Notification.
